Islam is a complete religion. It deals with every aspect related to our daily lives. The foundation of an ideal Islamic society is based on thoughtfulness and equality in all the matters. The Muslim Sharia deals effectively with the matters regarding educational, social, economical, familial, marital, judicial and even political issues that we come across in our lives on a regular basis.
The primary sources of sharia include Quran and Hadith. Quran is a divine source whose protection is taken care of by Allah Almighty himself. But we have to be extremely careful about considering the Hadith as authentic or unauthentic.
Only that Hadith is authentic which can be traced back to the life of Muhammad himself with proper sources. Sahih Bukhari and Sahih Muslim are the most reliable and authentic volumes of Hadith. The wordings can be traced easily as the narrations are done by the closest companions and family members of Muhammad.
The secondary sources use the primary sources to explain the matters which can not be understood by mere understanding. The Ijma and Qiyaas refer to the joint consensus and analogical reasoning. It is done by the qualified religious scholars who study each and every available material in order to solve a particular problem.
A complete and thorough understanding of Quran is a necessity, followed by deep study of Hadith. There are anecdotes present in the unauthentic volumes of Hadith which can be discarded easily if one has complete knowledge about Quran.
It is not an easy task to name any Sharia law as wrong or right. Several scholars have arguments about making a true islamic constitution which has everything in accordance with muslim sharia.
But, we are given easy procedures to deduct the most suitable ways to implement it. Only those laws are accepted which are proven correct by Quran and Ahadith. For example, if there is any saying of Muhammad which contradicts Quran then it is permissible to consider it wrong. Muhammad is the messenger of Almighty and he could never say or do anything which is not written in Quran.
Mainly, Sharia laws are based on equality among the citizens of a state or country. The rights of minorities are given without any discrimination. Womenfolk are never denied from getting education and they have every right to earn living.
They are not forced into marriages, their consent is equally important like the men. They are a separate entity who can actively participate in politics and social lives. The suppressing attitude is not a part of Sharia. It is the obligation of the ruler to provide complete justice with proper investigation of the crime. The rich and upper class is equal before the law just like the meager and poor population.
The wealth and inheritance related aspects are dealt with utmost care as well. The inheritance laws claim to give half share to the daughters and full to the son. The widow is also given proper share.
Females get share from their fathers as well as their husbands. So a simple Qiyaas aids in clearing the concept. Sharia Laws are based on common sense and knowledge both.
